PRIVACY POLICY OF NEC VIETNAM COMPANY LIMITED (“NEC VN”)

This Privacy Policy sets out how your personal data provided to NEC VN through this Site will be used and protected by NEC VN.

“Personal Data” refers to electronic information in the form of symbols, letters, numbers, images, sounds, or equivalences associated with you or used to identify you, such information includes but is not limited to your name, address or e-mail address.

By accepting this Policy, you as a business partner or a web user, accept and agree to be bound by NEC VN’s Privacy Policy governing the manner and use of your Personal Data by NEC VN. If you do not accept or agree with this Privacy Policy, you should leave this Site immediately and cease any further use of any materials you have obtained from this Site and not provide NEC VN with any of your Personal Data.


DISCLOSURE AND USE OF PERSONAL DATA

NEC VN collects, discloses and process your Personal Data to ensure the smooth provision of NEC VN’s services and products to you.

NEC VN may use your Personal Data for the following purposes:

  • to provide NEC VN’s services and products to you, such as the delivery of the products to you and for the registration of your product warranty;
  • to communicate with you for marketing purposes;
  • to contact you for customer satisfaction surveys and research purposes;
  • for NEC VN’s internal purposes such as auditing, data analysis, and research to improve NEC VN’s products, services, and customer communications; and/or for safety, security and legal compliance.

NEC VN may share and disclose your Personal Data to the following third parties:

  1. our parent company, subsidiaries or affiliates (“NEC Group of Companies”). In such an event, NEC VN will only transfer and NEC Group of Companies will only use and disclose your Personal Data in accordance with this Privacy Policy and the applicable laws;
  2. (i) NEC VN’s professional advisers, including without limitation NEC VN’s lawyers, accountants and auditors; (ii) NEC VN’s third party service providers who provide payment, administrative or other services in connection to the operation of this Site and/or NEC VN’s business; and/or (iii) NEC VN’s business alliance partners in order to fulfil the purposes listed in paragraph 2 of this Section “DISCLOSURE AND USE OF PERSONAL DATA”;
  3. reputable companies, who are our partners and may need to collect and maintain certain subscriber information to help NEC VN improve NEC VN’s services and products. In such an event, NEC VN will obtain your consent before sharing your Personal Data with any of them; and/or
  4. any acquirer whom NEC VN may sell all or part of its business to, in which event NEC VN may disclose your Personal Data to enable the acquirer to continue to provide the services and products to you.

NEC VN will not reveal your Personal Data to any third party unless such disclosure is:

  1. with your consent;
  2. to protect the life and health of you or others in an emergency situation;
  3. in accordance with the law;
  4. required by competent regulatory authorities in the event of a state of emergency regarding national defense, security, social order and safety, major disasters, or dangerous epidemics; when there is a threat to security and national defense but not to the extent of declaring a state of emergency; to prevent and fight riots and terrorism, crimes and law violations according to the provisions of law;
  5. to fulfill obligations under contracts between you and NEC VN as prescribed by law;
  6. to serve operations by regulatory authorities as prescribed by relevant Laws.
  7. as otherwise expressly provided for under this Privacy Policy and relevant Laws.

TRANSFER OF PERSONAL DATA

NEC VN may transmit your Personal Data to NEC VN’s data storage facilities with NEC VN’s parent company in Japan and/or NEC VN’s appointed agent in Singapore or in other countries in connection with NEC VN’s provision of services and products to you. Prior to such transmission, NEC VN will ensure reasonable security measures are in place which will ensure the confidentiality of your Personal Data as contained in NEC VN’s data storage facilities in Singapore and Japan or such other countries in which they are stored.


CONSENT

NEC VN will collect your Personal Data when you sign up for product information, participate in direct marketing etc.

By providing NEC VN with your Personal Data, you consent to any and all such use and disclosure stated in this Privacy Policy.

You may submit a request to withdraw your consent at any time by contacting our Privacy Compliance Supervisor at the email address provided herein. Please note that a withdrawal of your consent may affect NEC VN’s provision of products and services to you. In such an event, NEC VN will inform you first of the consequences of such withdrawal.


ACCESS AND AMEND

NEC VN will, upon your written request to our Privacy Compliance Supervisor at the email address provided herein, allow you to view your Personal Data.

NEC VN, based on your requirement, will amend your Personal Data.

NEC VN reserves the right to charge a reasonable administrative fee for any viewing or amending of your Personal Data as permitted by applicable law.

NEC VN reserves the right to deny you access to your Personal Data as permitted by applicable law.


RETENTION

NEC VN will not hold your Personal Data for any period longer than NEC VN believes is reasonably necessary for the purposes it was collected for or for such longer period as required for business or legal purposes or as required by applicable law.
When destroying your Personal Data, NEC VN will take commercially reasonable measures to make your Personal Data irrecoverable or irreproducible in accordance with the applicable law.


ACCURACY

NEC VN seeks your kind co-operation to ensure that your Personal Data are kept accurate and correct at all times. Should there be any change in your Personal Data, please contact our Privacy Compliance Supervisor at the email address provided herein.
NEC VN may also periodically request for you to update your Personal Data.

NEC VN may use cookies to recognize and track your computers. Cookies are small pieces of data stored on your computer’s hard drive, rather than on the websites. MODIFICATION OF THIS PRIVACY POLICY

NEC VN reserves the right to modify and change the contents of this Privacy Policy from time to time. You are responsible for regularly reviewing the contents of this Privacy Policy and agree that continued use of this Site and NEC VN’s services after any such changes or modification shall constitute your consent to such changes or modification. NEC VN does not and will not assume any obligation to notify you of any changes or modification to the Privacy Policy.

Links to third party websites on this Site are provided solely as a convenience to you. This Privacy Policy you just read is applicable only when you are on this Site, once you are linked to another website, you should read that website's privacy policy/statement before disclosing any Personal Data. You agree that NEC VN shall not be responsible for and hereby disclaim to the maximum extent permissible at law, any liability for the security or privacy practices included on or operated by these third party websites.


MINORS

NEC VN cannot distinguish the age of persons who access and use this Site. If a minor (according to applicable law) has provided NEC VN with his/her Personal Data without parental or guardian consent, the parent or guardian may contact our Privacy Compliance Supervisor at the email address provided herein for the deletion of the minor’s Personal Data


CONTRACTUAL OBLIGATIONS

This Privacy Policy is not intended to, nor does it create any obligations on NEC VN in respect of any other party or on behalf of any other party.


SEVERITY

If any of part of this Privacy Policy is invalid or unenforceable, it will be struck out and the remaining parts will remain in force.


GOVERNING LAW

This Privacy Policy will be governed and construed in accordance with the laws of Vietnam. Use of this Site is unauthorized in any jurisdiction that does not give full effect to all provisions of this Privacy Policy, including without limitation to this paragraph and liability exclusions above.


COMPLAINT RESOLUTION

If you reasonably believe that NEC VN is using your Personal Data collected other than as provided for in this Privacy Policy or you are not satisfied in the manner NEC VN is using or handling your Personal Data, you may bring a complaint to our Privacy Compliance Supervisor at the email address provided herein.
